Jeffrey Sloka is a former first earl kitchener of khartoum, Ont., brain doctor who is veneer 48 counts of sexual assault in connectedness to incidents dating back to 2010.
The judge says he finds that the Crown has failed to prove its case against Sloka and he says Sloka is not guilty of all 48 counts of sexual assault against him.
He says some patient testimony was "tainted" and the Crown failed to prove Sloka was acting in a sexual nature. The judge believes Sloka acted "according to his training" on each count and he should be acquitted.
Sloka appears to be listening intently as the judge gives background from the trial and starts explaining his decisions.
The judge has a computer monitor in front of him that’s displaying all the usernames of the people who have logged in to listen to the decision virtually.
Parry goes into the defence stand on this case.
The judge says the defence argued some evidence may have been fabricated.
He says the defence asked him to reject claims from Bril, arguing her evidence is “flawed” and she was biased.
The judge describes what methods the Crown used to prove Sloka sexually assaulted his patients.
That included bringing in Dr. Vera Bril to show Sloka’s methods were not neurologically justified.
The silence in the courtroom is heavy as the judge speaks.
Every eye is on Parry as he begins to read his decision.
Parry mentions the sexual assault charges against Sloka stem from incidents at the neurology clinic. Up to 21 counts were withdrawn and 48 counts remain.
He says the Crown alleges Sloka used unjustified methods to gain access to his patients.
Justice Craig Parry has started speaking.
He begins by saying he’ll be covering the Sloka decisions.
Because they are "too voluminous to read into the record," something that would take weeks to read, he’ll just read the introduction of the decision, which will give a summary, before giving the decisions themselves.
An electronic version of his report will be uploaded.
Court is now in session.
There are two benches with reserved signs in the front corner of the courtroom.
I recognize some of the people sitting there as Sloka's family members. They were here during previous court dates as well to show their support for Sloka.
Jeffrey Sloka has now arrived in court with his defence counsel, David Humphrey and Jill Makepeace.
His silver hair is closely cropped, and he’s wearing a black suit.
Crown attorneys Julia Forward and Sidney McLean are also here.
When Justice Craig Parry addresses the court, he’ll be handing down a lengthy decision: expected to be 1,000 pages.
Parry is a meticulous judge who would often ask lawyers to repeat themselves, in some cases more than once, to ensure he fully understood the information being presented.
It's expected his decision will also be very detailed.
