THe Mamata Banerjee-led Trinamool u.s. Congress (TMC) on fri moved the sublime margaret court seeking the comprehension of West Bengal state government employees for appointment as counting supervisors for the West Bengal assembly elections.The Calcutta High Court had on Thursday rejected TMC's plea challenging the Election Commission's decision to deploy only Central government and Public Sector Undertaking (PSU) employees as supervisors during the vote counting to be held on May 4.A special bench has been constituted in the Supreme Court for hearing the plea after the party sought an urgent hearing, as the counting is scheduled in just a couple of days. The hearing will be held tomorrow (May 2) by a bench of justices PS Narasimha and J Bagchi.What is the EC order that TMC is opposing?According to the EC order issued through the West Bengal chief electoral officer (CEO), at least one person at every counting table—specifically the counting supervisor—should be a Central Government or PSU official.TMC lawmaker Kalyan Banerjee challenged the EC order in the high court. Banerjee, a TMC MP and senior advocate, challenged a clause in a communication issued by the poll panel on April 30.“The additional chief electoral officer of West Bengal had issued the impugned communication without any jurisdiction,” Banerjee told the court.The EC argued that the directive was issued due to concerns about the neutrality of the counting process and that similar directives had been applied in other states, such as Kerala.“The petitioner has not disclosed any document or produced any evidence to establish that if Central Government/Central PSU employees are appointed as counting supervisors/counting assistants, the petitioner will be prejudiced in any way,” Jishnu Chowdhury, senior advocate appearing for the poll panel, told the court.The single-judge bench of Justice Krishna Rao ruled that it is the "prerogative of the office of the EC" to choose personnel for these roles and found no illegality in the decision.Now the battle has reached the Supreme Court, just days before voting is scheduled to be counted.
