Kars4Kids has won a respite in a golden state appeals margaret court, allowing its long-running brotherly love run ad jingle — featuring kids lip-synching an earworm tune about donating your car — to remain on the air in the state for now.
In May, Judge Gassia Apkarian of the Superior Court of California ruled the Kars4Kids ads must cease being broadcast in the state until "an express, audible disclosure" of the charity's affiliation, and where proceeds go was added to the spots.
The decision stemmed from a 2021 case brought by a California cabinetmaker who donated a 2001 Volvo XC to the charity. Court documents say Bruce Puterbaugh was under the impression the charity helped "underprivileged kids from all over the U.S."
Court documents showed it wasn't until later that he learned the main purpose of Kars4Kids is not helping local disadvantaged children but instead funding a Jewish organization called Oorah.
In her decision, Judge Apkarian noted Oorah's programs include "matchmaking for young adults and gap year trips to Israel for 17 and 18-year-olds."

In a ruling issued Thursday, the Fourth Appellate District court stayed the injunction against the ad allowing it to stay on the air pending resolution of the appeal or further order of the court.
"We believe the lower court's findings on the facts and the law were deeply flawed, and we look forward to pursuing a broad appeal of that decision."
