Daly said the legal issues around the cases are not new or complicated.
Emmett Macfarlane, a political-science professor at the University of Waterloo, told the Canadian Press that agreement from lower courts over the issue likely means the SCC wonât find a reason to get involved.
Legal challenges to the CFIAâs Dec. 31, 2024 cull order in the lower courts have already been unsuccessful.
If Canadaâs highest court decides today to not hear the farmâs case and lifts a temporary stay on the cull, there would be no legal barrier to destroying the birds, which number around 300, according to the CFIA.
If leave to appeal is granted, a final decision on the fate of the birds would come after a hearing.
The discovery of the H5N1 avian flu at the farm and the consequent cull order by the Canadian Food Inspection Agency (CFIA) has drawn international attention, protests and conflict at the farm.
The issue pits Canadaâs avian flu protocols â based on World Organisation for Animal Health policies â against the businessâs owners, who claim there is no longer H5N1 at the farm and the birds should not be destroyed, but used for scientific research instead.
Iâll be reporting today on whether the Supreme Court of Canada will hear an appeal by Universal Ostrich Farms Inc. In B.C.âs West Kootenay region.
The decision, expected at 6:45 a.m. PT, will determine if there will be a stay of the cull ordered for hundreds of ostriches at the farm, after avian flu was found among the flock in December 2024.
